Terms of Service and End User License Agreement

These Terms and Conditions, including the end user license terms below (“Terms”), govern your access to and use of CrossSwords, the CrossSwords website located at https://crossswordsgame.com, and any related applications, games, software, online multiplayer features, voice-chat features, websites, content, and services collectively provided by Foxtail Games LLC (“Foxtail,” “we,” “us,” or “our”).
Collectively, these products and features are called the “Services.”
By downloading, installing, accessing, purchasing, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not access or use the Services.
1. Eligibility
You must be at least 13 years old to use the Services.
If you are under the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms on your behalf and supervise your use of the Services.
The Services are not directed to children under 13. Children under 13 may not create an account, use online multiplayer, participate in voice chat, or otherwise use the Services.
You may not use the Services if applicable law prohibits you from doing so.
2. Platform Accounts and Cross-Platform Services
CrossSwords may use an account provided by Foxtail or an account supplied by a supported platform, including:
Apple Game Center;
Google Play Games or another Google service;
Steam;
supported console networks;
Firebase authentication; or
another identity or multiplayer provider.
Your use of a third-party platform is also governed by that platform’s terms, privacy policy, community rules, and account requirements.
You are responsible for:
maintaining control of your device and platform account;
keeping account credentials secure;
ensuring that information associated with your account is accurate;
all activity occurring through your account; and
promptly notifying us if you believe your account has been compromised.
Do not sell, transfer, share, or provide unauthorized access to your account.
We may use platform-specific identifiers to associate your progress, purchases, settings, multiplayer history, or enforcement history with your account.
3. License to Use CrossSwords
Subject to your compliance with these Terms, Foxtail grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use CrossSwords for your personal, noncommercial entertainment.
CrossSwords is licensed, not sold.
Except where applicable law expressly permits otherwise, you may not:
copy, reproduce, distribute, sell, rent, lease, sublicense, or commercially exploit the Services;
reverse engineer, decompile, disassemble, translate, modify, or create derivative works from the Services;
extract or redistribute crossword puzzles, clues, answers, maps, characters, artwork, music, software, databases, or other game content;
use bots, scripts, automation, unauthorized software, cheats, hacks, mods, exploits, or data-mining tools;
bypass security, access controls, payment systems, matchmaking rules, or technical restrictions;
access servers, systems, or data without authorization;
use the Services to develop or improve a competing product, artificial-intelligence model, dataset, or commercial service; or
remove copyright, trademark, attribution, or proprietary notices.
Foxtail and its licensors retain all rights not expressly granted under these Terms.
4. Online Multiplayer
CrossSwords includes online multiplayer functionality. Multiplayer availability may depend on:
your internet connection;
your platform account;
compatible versions of the game;
regional server availability;
third-party services;
maintenance;
player population; and
compliance with these Terms.
Matchmaking results, latency, connection quality, teammate behavior, and uninterrupted access are not guaranteed.
You understand that other players may see information such as your display name, avatar, platform, gameplay activity, match statistics, leaderboard placement, and other information designed to be visible during gameplay.
5. Voice Chat
CrossSwords may provide optional real-time voice chat during online matches.
By enabling or using voice chat, you authorize CrossSwords and its voice-service provider to access your microphone and transmit your voice to other participants in the match.
Under CrossSwords’ current design:
voice chat is transmitted only while you participate in an active match;
Foxtail does not intentionally record or retain the content of voice chat;
voice communications may be temporarily processed by a voice-service provider as technically necessary to transmit them; and
connection metadata may be processed for security, diagnostics, matchmaking, or service operation.
You can deny microphone permission, mute yourself, mute other players, or disable voice chat through available game, operating-system, or platform settings. CrossSwords should remain playable without voice chat, although some social functionality may be reduced.
No expectation of privacy
Voice chat is a communication with other players. Do not say anything that you expect to remain private.
Other participants may independently record, stream, photograph, repeat, or distribute communications using tools outside Foxtail’s control. Foxtail is not responsible for recordings or disclosures made independently by other players.
Do not disclose your real name, home address, telephone number, financial information, passwords, precise location, or other sensitive personal information through voice chat.
6. Community and Conduct Rules
You must treat other players fairly and respectfully.
You may not use the Services, including display names, profile information, voice chat, or other communications, to:
harass, bully, stalk, threaten, intimidate, or abuse another person;
use hateful, discriminatory, or dehumanizing language;
promote violence or threaten physical harm;
engage in sexual harassment or direct sexual content toward minors;
groom, exploit, solicit, or endanger a minor;
impersonate another person, company, moderator, or Foxtail representative;
disclose another person’s private information;
encourage self-harm, criminal activity, fraud, or dangerous conduct;
advertise, spam, scam, phish, or distribute malware;
infringe copyrights, trademarks, privacy rights, or other rights;
interfere with a match or intentionally ruin another player’s experience;
collude, manipulate rankings, intentionally lose, or improperly disclose protected match information;
cheat, exploit bugs, or use unauthorized software;
evade a mute, suspension, ban, or other enforcement action; or
violate applicable law or platform community standards.
We may investigate reports using available account information, match records, technical logs, user submissions, screenshots, recordings voluntarily supplied by players, and other available evidence.
Because Foxtail does not intentionally retain voice-chat audio under the current design, we may be unable to independently verify every voice-chat report.
7. Reporting, Muting, and Enforcement
Where available, you may mute, block, or report another player.
You can also report serious conduct to contact@foxtailgames.io. Include the player’s display name, approximate match time, platform, and a description of what occurred.
We may take any action we reasonably consider appropriate, including:
issuing a warning;
removing content or a display name;
limiting communication features;
removing a player from a match;
resetting rankings, progress, rewards, or statistics;
temporarily suspending access;
permanently banning an account or device;
reporting conduct to a platform provider; or
contacting law enforcement when reasonably necessary.
We are not required to disclose confidential investigation materials, enforcement methods, reports submitted by others, or security information.
Enforcement decisions may be based on the severity, frequency, context, and available evidence relating to the conduct.
8. Player Content and Communications
“Player Content” means information or material you submit or communicate through the Services, including display names, profile information, feedback, reports, and communications.
You retain any rights you have in your Player Content.
You grant Foxtail a worldwide, non-exclusive, royalty-free license to host, reproduce, transmit, display, modify for technical purposes, and otherwise process Player Content only as reasonably necessary to:
provide the Services;
transmit communications to their intended recipients;
operate multiplayer features;
investigate reports;
enforce these Terms;
improve and secure the Services; and
comply with law.
For real-time voice chat, this license is limited to the processing and transmission necessary to provide the voice-chat feature unless you separately submit a recording or other evidence to us.
You represent that you have the rights necessary to submit your Player Content and that it does not violate these Terms or another person’s rights.
9. Purchases, Subscriptions, and Refunds
CrossSwords may be offered for free, for a one-time purchase, through a subscription, through in-app purchases, through advertising, or through a combination of these models.
Purchases are generally processed by the platform through which you obtained the Services, such as Apple, Google, or Steam. The platform’s payment terms, subscription rules, and refund policies apply.
Foxtail generally does not receive your complete payment-card information.
Prices, taxes, available content, currencies, and payment methods may vary by platform or region.
If CrossSwords offers an automatically renewing subscription:
the price and billing period will be displayed before purchase;
the subscription will renew unless canceled through the applicable platform before renewal;
deleting the game does not automatically cancel a subscription; and
subscription management and cancellation must generally be completed through the platform account used to purchase it.
Except where required by law or applicable platform policy, purchases are final and non-refundable.
10. Virtual Items and Unlockable Content
CrossSwords may include virtual items, cosmetics, archive access, rewards, currencies, achievements, or other digital entitlements.
Virtual items:
are licensed rather than sold;
have no cash value;
cannot be redeemed for money unless expressly stated;
may not be sold or transferred outside an authorized feature;
may be modified, balanced, replaced, or discontinued; and
may be lost when an account is terminated for violating these Terms.
We may change gameplay balance, rewards, pricing, availability, or functionality when reasonably necessary to operate or improve the game.
11. Advertising and Promotions
CrossSwords may display advertisements or promotional material.
Advertising may be contextual or, where permitted and with any required consent, personalized using information such as device identifiers, approximate location, advertising interactions, and gameplay activity.
Third-party advertisements may link to products or services that Foxtail does not own or control. Foxtail is not responsible for third-party products, services, claims, content, or transactions.
Promotions, contests, or sweepstakes may have additional rules. If those rules conflict with these Terms, the promotion-specific rules control for that promotion.
12. Updates and Changes to the Services
We may release patches, updates, balance changes, new content, security fixes, or compatibility changes.
Some updates may be required to continue using online features.
We may modify, suspend, restrict, or discontinue part or all of the Services. Where reasonably practical, we will provide notice of material discontinuations, but uninterrupted or permanent availability is not guaranteed.
13. Third-Party Services
The Services may depend on or integrate with third parties, including platform account providers, storefronts, multiplayer networks, voice-chat providers, hosting companies, analytics providers, crash-reporting tools, and advertising networks.
Foxtail does not control those services and is not responsible for their independent actions, outages, security practices, content, or privacy practices.
Your use of third-party services may be subject to separate terms.
14. Intellectual Property
CrossSwords, Foxtail Games, the CrossSwords name and logo, game software, artwork, characters, sounds, music, maps, interfaces, puzzle presentation, and other original content are owned by or licensed to Foxtail and are protected by intellectual-property laws.
Individual crossword puzzles, clues, answers, or other materials may also be owned by third-party licensors.
No rights are granted to use Foxtail’s trademarks, logos, branding, or copyrighted material outside the limited license expressly provided by these Terms.
15. Feedback
You may voluntarily provide suggestions, ideas, bug reports, or other feedback.
You grant Foxtail a perpetual, worldwide, irrevocable, royalty-free right to use and incorporate that feedback without restriction or compensation, provided that this does not grant us ownership of unrelated intellectual property included in your communication.
Do not submit confidential information through feedback.
16. Suspension and Termination
You may stop using the Services at any time.
You may request account and associated-data deletion as described in the Privacy Policy.
We may suspend or terminate access when we reasonably believe that:
you violated these Terms;
your account presents a security or fraud risk;
suspension is required by a platform provider or law;
your conduct threatens another player or the Services; or
continued access could expose Foxtail or another person to harm or liability.
Sections that by their nature should survive termination will survive, including intellectual-property, disclaimers, limitations of liability, indemnity, and dispute provisions.
17. Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available.”
Foxtail disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, accuracy, security, and compatibility.
We do not warrant that:
the Services will always be available or error-free;
defects will always be corrected;
online matches will be fair, uninterrupted, or free from offensive conduct;
every report will result in enforcement;
player communications will remain private; or
progress or online data will never be lost.
Some jurisdictions do not permit certain warranty exclusions, so some exclusions may not apply to you.
18. Limitation of Liability
To the maximum extent permitted by law, Foxtail and its owners, employees, contractors, affiliates, and licensors will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, lost opportunities, or interruption of service.
To the maximum extent permitted by law, Foxtail’s total liability arising from or relating to the Services or these Terms will not exceed the greater of:
the amount you paid directly for CrossSwords during the 12 months preceding the event giving rise to the claim; or
one hundred United States dollars.
These limitations apply regardless of the legal theory and even if Foxtail was advised that damages were possible.
Nothing in these Terms excludes liability that cannot legally be excluded, including liability for fraud, intentional misconduct, or personal injury caused by negligence where applicable law prohibits exclusion.
19. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Foxtail and its owners, employees, contractors, affiliates, and licensors from claims, liabilities, damages, losses, and reasonable expenses arising from:
your unlawful use of the Services;
your material violation of these Terms;
your Player Content;
your infringement of another person’s rights; or
your fraudulent, abusive, or intentionally harmful conduct.
This provision does not require you to indemnify Foxtail for Foxtail’s own unlawful conduct.
20. Governing Law and Disputes
These Terms are governed by the laws of the State of Georgia and applicable federal law, without regard to conflict-of-law principles.
Before filing a legal claim, you and Foxtail agree to make a reasonable, good-faith attempt to resolve the dispute informally. A written notice should describe the dispute and requested resolution and be sent to contact@foxtailgames.io.
Unless applicable consumer law requires otherwise, legal proceedings must be brought in a court with jurisdiction in Hall County, Georgia, or the applicable federal court serving that area.
If you live in a jurisdiction whose consumer-protection laws require the application of local law or permit proceedings in your home jurisdiction, those mandatory protections are not waived.
21. Additional Terms for Apple Users
If you download CrossSwords through an Apple App Store:
These Terms are between you and Foxtail, not Apple.
Foxtail, not Apple, is solely responsible for CrossSwords and its content.
Your license is limited to a non-transferable license to use CrossSwords on Apple-branded products that you own or control, as permitted by Apple’s usage rules, including any applicable Family Sharing rules.
Apple has no obligation to provide maintenance or support for CrossSwords.
To the extent a warranty legally applies and CrossSwords fails to conform to it, you may notify Apple, and Apple may refund the applicable purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation.
Foxtail, not Apple, is responsible for addressing claims relating to CrossSwords, including product-liability, legal-compliance, and consumer-protection claims.
Foxtail, not Apple, is responsible for investigating and resolving claims that CrossSwords infringes third-party intellectual-property rights.
You represent that you are not located in a country subject to a United States government embargo and are not listed on a United States government restricted-party list.
You must comply with applicable third-party terms when using CrossSwords.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-specific provisions against you.
22. Changes to These Terms
We may update these Terms to reflect changes in the Services, law, technology, business practices, or safety requirements.
We will update the “Last Updated” date when changes are published. Where required, we will provide additional notice or request renewed acceptance.
Your continued use after updated Terms become effective constitutes acceptance where permitted by law. If you do not agree to an update, you must stop using the Services.
23. General Terms
If any provision is found unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will remain effective.
Our failure to enforce a provision is not a waiver.
You may not assign these Terms without our consent. Foxtail may assign them in connection with a merger, acquisition, restructuring, financing, or sale of assets.
These Terms, the Privacy Policy, and any applicable promotion or platform-specific terms constitute the entire agreement regarding the Services.
