Foxtail Games LLC (“Foxtail,” “we,” “us,” or “our”) operates CrossSwords, the CrossSwords website located at https://crossswordsgame.com, and related applications, online multiplayer features, voice-chat features, websites, and services.

This Privacy Policy explains how we collect, use, disclose, retain, and protect information when you use CrossSwords and our related services collectively referred to as the “Services.”

1. Who Is Responsible for Your Information?

Foxtail Games LLC is the controller or business responsible for personal information collected directly through CrossSwords, except where another company independently controls information collected through its own platform or service.

Third-party platforms—including Apple, Google, Steam, multiplayer providers, voice providers, analytics providers, and advertising providers—may separately process information under their own privacy policies.

2. Information We Collect

The information collected depends on your platform, settings, account type, location, and how you use CrossSwords.

A. Account and platform information

We may receive or generate:

  • an internal CrossSwords or Firebase user identifier;

  • Apple Game Center identifiers;

  • Google Play Games identifiers;

  • Steam identifiers;

  • identifiers from supported console networks;

  • display name or platform nickname;

  • avatar or profile image;

  • authentication tokens;

  • account creation and last-login dates;

  • age range or date-of-birth information where an age gate is used;

  • country or general region; and

  • platform privacy or parental-control settings made available to us.

We generally do not receive your platform password.

B. Gameplay and multiplayer information

We may collect:

  • matches joined or created;

  • room or lobby identifiers;

  • matchmaking information;

  • scores, wins, losses, rankings, and achievements;

  • crossword progress, answers, gameplay actions, and match outcomes;

  • unlocked content and inventory;

  • referrals and referral rewards;

  • teammates, opponents, or friends you interact with;

  • reports submitted about players;

  • enforcement actions and account sanctions;

  • session length and gameplay events; and

  • server, synchronization, and connection information.

Some multiplayer information—such as display name, avatar, score, gameplay actions, and voice communications—is disclosed to other players as part of the game.

C. Voice-chat information

CrossSwords may offer optional real-time voice chat during online matches.

When you enable voice chat:

  • the game accesses your microphone with your device’s permission;

  • your voice is transmitted to other players in the match through Photon or another voice-service provider;

  • voice audio is processed as necessary to transmit the communication; and

  • technical information such as room identifier, connection status, latency, packet information, microphone state, and speaking activity may be processed.

Foxtail does not intentionally record or retain the content of voice chat under CrossSwords’ current design. Voice audio is intended to exist only as a real-time transmission during an active match.

Our voice provider may temporarily process audio packets and associated technical data as necessary to deliver the transmission, maintain security, diagnose errors, and comply with its legal obligations.

Other players may independently record or distribute communications using tools outside our control. Do not communicate sensitive personal information through voice chat.

If we later introduce voice recording, voice transcription, automated voice moderation, or voice-report evidence, we will update this Privacy Policy and provide any notice or consent required by law before activating that processing.

D. Device, network, and technical information

We and our service providers may automatically collect:

  • IP address;

  • device type and model;

  • operating system and version;

  • app version;

  • language and time zone;

  • device or installation identifiers;

  • advertising identifier, where permitted;

  • browser type;

  • internet service provider;

  • approximate location derived from IP address;

  • crash reports;

  • error logs;

  • performance and diagnostic information;

  • network latency and connection quality;

  • referral source;

  • pages or screens viewed; and

  • dates and times of access.

E. Purchase information

When you make a purchase, the applicable platform or storefront processes the transaction.

We may receive:

  • the item purchased;

  • purchase date and price;

  • currency and country;

  • subscription status;

  • transaction or receipt identifier;

  • entitlement information; and

  • refund or chargeback status.

Foxtail generally does not receive or store your full payment-card number.

F. Analytics information

We may use Firebase, Google Analytics for Firebase, platform analytics, or similar services to understand:

  • how players discover CrossSwords;

  • which features are used;

  • how long sessions last;

  • where players encounter errors;

  • how players progress through the game;

  • whether advertisements or promotions are effective; and

  • how we can improve performance and game balance.

Analytics providers may collect device identifiers, app-instance identifiers, IP address, approximate location, gameplay events, advertising interactions, and technical data.

G. Advertising information

CrossSwords may display advertising.

Subject to your settings, location, and any required permission, we and advertising partners may process:

  • advertising identifiers;

  • IP address;

  • device and app information;

  • approximate location;

  • ad impressions;

  • ad clicks or interactions;

  • conversion events;

  • gameplay or audience segments; and

  • consent and opt-out status.

Advertising may be contextual or personalized.

On platforms that require permission before tracking activity across apps or services, we will request that permission before engaging in such tracking.

H. Website and cookie information

When you visit https://crossswordsgame.com, we may use cookies, local storage, pixels, and similar technology.

These may be used for:

  • essential website operation;

  • security;

  • saving preferences;

  • measuring traffic;

  • identifying referral sources;

  • analytics; and

  • advertising, where permitted.

Where required, non-essential cookies will be used only after consent.

I. Communications and support

When you contact us, submit feedback, request support, report another player, participate in a survey, or exercise a privacy right, we may collect:

  • platform and account identifiers;

  • message content;

  • attachments or screenshots;

  • information about your device or match;

3. Where Information Comes From

We collect information:

  • directly from you;

  • automatically from your device or use of the Services;

  • from Apple, Google, Steam, or another supported platform;

  • from Firebase and our infrastructure providers;

  • from multiplayer and voice-service providers;

  • from analytics and advertising providers;

  • from other players who submit reports; and

  • from publicly available or legally permitted sources when necessary to investigate fraud, abuse, or security incidents.

4. How We Use Information

We use information to:

Provide the Services

  • authenticate players;

  • save progress and settings;

  • enable multiplayer matchmaking;

  • operate leaderboards and achievements;

  • transmit real-time voice chat;

  • process purchases and entitlements;

  • synchronize gameplay between devices; and

  • provide customer support.

Protect players and the Services

  • detect cheating, fraud, abuse, account compromise, and unauthorized access;

  • enforce our Terms and community rules;

  • investigate player reports;

  • prevent ban evasion;

  • protect minors and other players;

  • maintain service integrity; and

  • comply with platform security requirements.

Improve CrossSwords

  • analyze feature use;

  • diagnose crashes and connection problems;

  • test updates;

  • balance gameplay;

  • develop new features;

  • measure performance; and

  • understand player preferences.

Communicate with you

  • respond to support requests;

  • send service-related notices;

  • provide security alerts;

  • notify you of material policy changes; and

  • send marketing communications where permitted.

Provide and measure advertising

  • select and display advertisements;

  • limit repeated advertisements;

  • measure impressions and conversions;

  • detect advertising fraud; and

  • personalize advertising where you have provided any legally required consent.

Meet legal obligations

  • maintain records;

  • respond to lawful government requests;

  • establish, exercise, or defend legal claims;

  • comply with tax, accounting, consumer-protection, and platform requirements; and

  • protect rights, safety, and property.

5. Legal Bases for Processing

Where laws such as the European Economic Area or United Kingdom data-protection laws require a legal basis, we rely on:

Performance of a contract

We process account, gameplay, multiplayer, purchase, and related technical information to provide the Services you request.

Legitimate interests

We process information to secure the Services, prevent cheating and fraud, improve CrossSwords, provide support, understand performance, and protect players.

We consider the impact on your rights when relying on legitimate interests.

Consent

We rely on consent where required for:

  • microphone access;

  • non-essential cookies;

  • personalized advertising;

  • cross-app tracking;

  • certain analytics;

  • marketing communications; and

  • processing involving minors where parental consent is required.

You may withdraw consent through available settings or by contacting us. Withdrawal does not affect processing that occurred before consent was withdrawn.

Legal obligations

We process information when necessary to comply with law, valid legal process, platform rules, or regulatory obligations.

Protection of vital interests

In rare cases, we may process or disclose information when reasonably necessary to protect someone from a serious and immediate threat.

6. How We Disclose Information

We may disclose information in the following circumstances.

A. Other players

Other players may receive information necessary for multiplayer interaction, including:

  • display name;

  • avatar;

  • platform or cross-play status;

  • gameplay actions;

  • score and match results;

  • leaderboard information; and

  • voice communications during a match.

B. Service providers

We may disclose information to vendors that provide:

  • cloud hosting and databases;

  • authentication;

  • multiplayer networking;

  • voice transmission;

  • analytics;

  • crash reporting;

  • customer support;

  • security and anti-fraud services;

  • email delivery;

  • website hosting; and

  • advertising and attribution.

These providers may process information only for the relevant services or under their own disclosed responsibilities, depending on the provider and relationship.

Providers may include Google/Firebase, Apple, Valve/Steam, Photon, platform operators, and advertising or analytics providers used in the applicable version of CrossSwords.

C. Platform operators

We may exchange information with Apple, Google, Valve, or another platform to:

  • authenticate your account;

  • verify purchases;

  • provide achievements or leaderboards;

  • enable multiplayer;

  • process refunds;

  • investigate violations; and

  • satisfy platform obligations.

D. Legal and safety disclosures

We may disclose information when we reasonably believe disclosure is necessary to:

  • comply with law, court orders, subpoenas, or legal process;

  • respond to lawful government requests;

  • investigate fraud, abuse, threats, or security incidents;

  • protect players, Foxtail, or the public;

  • enforce agreements; or

  • establish or defend legal claims.

E. Business transactions

Information may be disclosed or transferred during negotiations or completion of a merger, acquisition, financing, restructuring, bankruptcy, or sale of assets.

Any successor will be required to handle personal information consistently with applicable law and this Privacy Policy or provide appropriate notice of changes.

F. With your direction or consent

We may disclose information when you direct us to do so or provide consent.

7. Sale, Sharing, and Targeted Advertising

Foxtail does not sell personal information in exchange for money.

CrossSwords may disclose device identifiers, advertising information, analytics events, and activity information to advertising or attribution partners. Certain privacy laws may define some of these disclosures as “sharing,” “targeted advertising,” or a “sale,” even when no money is exchanged for the information itself.

Where applicable, you may opt out through:

  • CrossSwords privacy settings, when available;

  • a cookie or consent interface on our website;

  • your operating-system advertising settings;

  • platform privacy settings;

  • denying tracking permission; or

  • emailing contact@foxtailgames.io.

We do not knowingly sell or share personal information belonging to children under 16 for targeted advertising.

8. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy.

Retention depends on the type of information:

  • Voice content: Foxtail does not intentionally record or retain real-time voice-chat content under the current design.

  • Account and progress information: Generally retained while your account remains active and for a reasonable period afterward to process deletion, restore accidental loss, prevent fraud, or comply with law.

  • Match and enforcement information: Retained as reasonably necessary to operate the game, maintain rankings, investigate reports, enforce bans, and prevent abuse.

  • Technical and security logs: Retained for a limited period appropriate for diagnostics, security, anti-cheat, and fraud prevention.

  • Analytics information: Retained according to our settings and the retention policies of the analytics provider, and may later be aggregated or de-identified.

  • Purchase records: Retained as required for accounting, tax, consumer-protection, fraud-prevention, and platform obligations.

  • Support communications: Retained while needed to resolve the issue and maintain an appropriate support history.

  • Legal records: Retained for applicable limitation periods and as required to establish or defend legal claims.

Information may remain temporarily in backups after deletion until backups are overwritten through normal operations.

We may retain aggregated or de-identified information that can no longer reasonably identify you.

9. Your Choices and Controls

Microphone and voice chat

You can:

  • deny or revoke microphone permission;

  • mute yourself;

  • mute another player;

  • disable voice chat; or

  • use platform parental controls where available.

Revoking microphone permission prevents CrossSwords from transmitting your voice.

Account and platform settings

You can manage platform information through your Apple, Google, Steam, or other platform settings.

Certain information controlled by those platforms must be accessed or deleted through the platform provider.

Advertising

You may reset or restrict your device advertising identifier, deny tracking permission, use applicable consent controls, or request an opt-out.

Cookies

You may manage cookies through our website consent interface or browser settings. Blocking essential cookies may prevent portions of the website from functioning.

Marketing

You may unsubscribe from promotional emails using the link in the message or by contacting us. We may still send necessary service, security, transactional, or legal notices.

10. Accessing or Deleting Your Account and Data

You may request access, correction, or deletion of personal information by emailing:

Include:

  • your CrossSwords display name;

  • the platform you use;

  • your platform or player identifier, when available;

  • the country or state where you live; and

  • the specific request you are making.

Do not send your password.

We may need to verify that you control the relevant account before completing a request.

Deleting a CrossSwords account may permanently remove progress, rankings, unlocked content, social connections, and other account data. Purchases associated with a platform may continue to appear in that platform’s transaction history.

Some information may be retained when reasonably necessary for security, fraud prevention, legal compliance, dispute resolution, or enforcement of bans.

Deleting CrossSwords from your device does not automatically delete your account or cancel a subscription.

11. Privacy Rights

Depending on where you live, you may have the right to:

  • know whether we process your personal information;

  • access personal information;

  • correct inaccurate information;

  • delete information;

  • receive a portable copy of certain information;

  • restrict certain processing;

  • object to certain processing;

  • opt out of sale, sharing, or targeted advertising;

  • withdraw consent;

  • appeal a denied privacy request; and

  • lodge a complaint with a data-protection authority.

These rights may be subject to legal exceptions.

You will not be discriminated against for exercising applicable privacy rights.

We may request information necessary to verify your identity. An authorized agent may submit a request where permitted, but we may require proof of authorization and verification of the consumer’s identity.

12. California and Other United States State Privacy Disclosures

For purposes of applicable United States state privacy laws, we may collect the following categories:

  • identifiers;

  • customer-record information;

  • commercial or transaction information;

  • internet or electronic-network activity;

  • approximate geolocation;

  • audio information transmitted through voice chat;

  • inferences about gameplay preferences;

  • account credentials or authentication information; and

  • other information you submit.

We collect and use these categories for the business and commercial purposes described in Sections 4 and 6.

We do not use or disclose sensitive personal information for purposes other than providing, securing, and improving the Services or as otherwise permitted by applicable law.

We do not knowingly sell or share the personal information of users under 16 for targeted advertising.

13. Children’s Privacy

CrossSwords is not directed to children under 13, and children under 13 may not use the Services.

We do not knowingly collect personal information from a child under 13. If we learn that such information has been collected, we will take reasonable steps to delete it.

A parent or guardian who believes a child under 13 has provided information may contact contact@foxtailgames.io.

In jurisdictions where the minimum age for consent-based data processing is higher than 13, players below that age may need authorization from a parent or guardian for certain features, including personalized advertising, non-essential analytics, or voice chat.

Parents and guardians should review device controls, platform parental controls, voice-chat settings, and privacy settings before allowing a minor to use online multiplayer features.

14. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information.

These may include access controls, authentication, encryption in transit, logging, backups, vendor controls, and security monitoring.

No system is completely secure. We cannot guarantee that unauthorized access, loss, alteration, or disclosure will never occur.

You should protect your device and platform account and notify us promptly if you suspect unauthorized access.

15. International Data Transfers

Foxtail is based in the United States.

Your information may be processed in the United States and other countries where we or our service providers operate. Those countries may have privacy laws different from those where you live.

Where required, we rely on recognized transfer mechanisms, contractual protections, adequacy decisions, or other lawful safeguards.

16. Third-Party Links and Services

The Services may contain links to or integrations with third-party websites, storefronts, advertisements, communities, or services.

Their privacy practices are governed by their own policies. This Privacy Policy does not apply to information independently collected by those third parties.

Review their policies before providing information.

17. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in CrossSwords, our providers, law, or data practices.

We will update the “Last Updated” date when changes are published.

For material changes, we may provide notice through the game, website, email, platform notice, or another appropriate method. Where required, we will request renewed consent.
